Former governor of Gombe State, Mohammed Danjuma Goje, has filed an appeal against the judgement affirming his dismissal from the All Progressives Congress (APC). The Senator representing Gombe  Central Senatorial District also filed a stay of execution at the Court of Appeal in Abuja. A Federal High Court in Abuja presided by Justice Obiora Egwuatu had on June 27 dismissed the suit filed by Goje challenging his dismissal from the APC for lacking in merit. 

In an appeal dated July 4 and filed through his counsel, Paul Erokoro (SAN), Goje submitted that the trial judge’s reliance on the technicality that the deponent was a practicing lawyer in the law firm representing Goje although he was not involved in the suit, was not substantial justice.

Presidential Candidate of the Labour Party (LP), Peter Obi, has accused the Independent National Electoral Commission (INEC) of cloning electoral fraudsters as leaders and wasting the time and resources of the country. In their final address filed before the Presidential Election Petitions Court dated July 23, 2023, Obi and LP warned that if the court fails to whip INEC into line to do its electoral duties fairly, impartially and independently, elections in Nigeria will remain a fraud.

Obi and LP accused INEC of abandoning its primary statutory responsibility of being an electoral umpire; and proudly, put on the toga of a candidate in the election it conducted. They said INEC tragically and embarrassingly, spent 5.5 pages of its address defending the ground on the non-qualification of 2nd respondent (Tinubu). Obi further submitted that pursuant to the mandatory provisions of the Electoral Act, 2022, the INEC Regulations and Guidelines, and INEC Manual, INEC introduced the use of modern technology for the conduct of the 2023 General election.

“By this, INEC represented and assured that it would use Bimodal Voter Accreditation System (BVAS) for the accreditation of voters in the polling units and the upload/transmission of the results of the election in real-time on the day of the election to the INEC Result Viewing Portal (IReV). “However, contrary to the requirement of the law and in manifest disregard of its own representations, the 1st respondent (INEC) abandoned and discarded the much expected upload/transmission of the result of the election in real time on the day of the election from the polling unit to the IReV.

“Rather, and very strangely, blurred, unreadable and inaccessible documents/images were uploaded by the 1st respondent to the IReV purporting same to be the result of the election in various polling units. These blurred images and inaccessible documents were purported to be the result of the election in the polling units. The net result of the upload of the blurred images on the IReV, was that the result of the election could neither be authenticated nor verified, and thus, lacked credibility and transparency.

The Labour Party (LP) and its presidential candidate, Peter Obi, have clashed with the Independent National Electoral Commission (INEC) over the commission’s chairman’s alleged refusal to accept a subpoena.

The disagreement arose after LP’s lead counsel, Livy Uzoukwu (SAN), told the Presidential Election Petitions Court on Wednesday that Prof Mahmoud Yakubu had been evading service of subpoenas on him. Uzoukwu expressed confidence that the INEC lawyers would accept the service and that the proceedings would resume on Thursday.

However, INEC counsel Kemi Pinheiro (SAN) objected to the submission, claiming that the chairman had already received a subpoena from the Peoples Democratic Party (PDP).

The Presidential Election Petition Court has admitted the final report of the European Union Election Observer Mission in Nigeria, which faulted the conduct of the February 25 presidential election. The panel, presided by Justice Haruna Tsammani, admitted the document after it was tendered by the Peoples Democratic Party (PDP) and its candidate, Atiku Abubakar. The EU mission claimed the election did not show credibility, fairness, and transparency, with only 31% of the results uploaded on IREV. The court agreed with the PDP counsel, who admitted that the electoral body had no electronic collation system for election results. The INEC witness admitted that the collation of the results was done manually by the presiding officers of the electoral body. The witness also admitted that a technical glitch affected the uploading of the results, but it was not reported to Amazon Web Services by the INEC.
